Blueberry River Indian Band v. Canada (Department of Indian Affairs and Northern Development) [1995] 4 SCR 344

The Court applied Guerin v. The Queen (Period 8 above) and held the Crown liable for breach of its fiduciary obligations because it failed to retain the mineral rights for the First Nation when it sold surrendered reserve land. The Court also said that the Crown's fiduciary obligations have to be formulated so as to respect the decision-making authority of Indian bands.
